1. Agreement
These Terms of Service ("Terms") govern access to and use of Makao Homes, including related web applications, APIs, and services (collectively, the "Platform"). By creating an account, logging in, or using the Platform, you agree to these Terms.
If you use the Platform on behalf of an organization, you represent that you have authority to bind that organization.
2. Platform Description
Makao Homes provides a property operations and service-request workflow platform, including:
- property and unit administration,
- consultant discovery and bidding workflows,
- payment initiation and hold/release workflows,
- communications, alerts, and account security features.
3. Eligibility and Accounts
You must:
- provide accurate registration and profile information,
- maintain confidentiality of account credentials,
- promptly notify us of unauthorized access,
- comply with applicable laws and these Terms.
You are responsible for activity under your account, including actions by invited users and team members.
4. Roles and Permissions
Platform capabilities depend on user role and granted permissions (for example: superadmin, admin, manager, publisher, consultant, user). You may only perform actions permitted by your role and assignment scope.
5. Acceptable Use
You may not:
- use the Platform for unlawful, fraudulent, or abusive purposes,
- attempt unauthorized access or privilege escalation,
- interfere with service integrity, availability, or security,
- upload malicious code or exploit vulnerabilities,
- misuse personal data or confidential information.
We may suspend or terminate access for violations.
6. Service Requests, Bids, and Acceptance
- Consultants may submit bids where allowed by workflow and eligibility rules.
- Owners/requesters select bids and initiate payment according to platform flow.
- Bid acceptance may be gated by payment confirmation; where this applies, acceptance occurs only after successful payment confirmation.
- Platform records (status, events, timestamps) are the system of record for workflow state.
7. Payments, Fees, and Escrow-Style Holds
7.1 Payment initiation
Payments are initiated through supported rails/providers. You authorize the Platform and payment provider to process submitted payment instructions.
7.2 Fees
Applicable platform fees and fee modes are disclosed at checkout. You are responsible for reviewing totals before payment.
7.3 Held funds and release
Where applicable, funds may be held pending release workflows. Release may be triggered by approval actions or configured operational rules.
7.4 Failed or interrupted payments
A request remains unpaid/unaccepted where payment fails, expires, or is not confirmed.
8. Sponsored Placement and Boost Features
Where offered:
- profile sponsorship and/or bid boost features are paid visibility features,
- purchase does not guarantee job award, conversion, or revenue,
- ranking outputs may consider multiple factors (e.g., boost amount, quality signals, experience),
- sponsored/boosted labels may be displayed for transparency.
Additional commercial terms may apply to these products.
9. Third-Party Services
The Platform may rely on third-party processors/providers (payments, messaging, storage, mapping, AI-assisted content). Availability or performance of those services may affect Platform functionality.
10. Data and Privacy
Use of personal data is governed by the Privacy Policy. You must process any personal data accessed through the Platform lawfully and only for authorized purposes.
11. Intellectual Property
The Platform, software, and related materials are owned by or licensed to Makao Hive. Subject to these Terms, we grant a limited, non-exclusive, revocable right to use the Platform.
You retain rights in content you submit, but grant us rights necessary to operate, secure, and improve the Platform.
12. Service Availability and Changes
We may:
- modify features and workflows,
- apply maintenance windows and updates,
- limit or suspend access to protect users or the service.
We do not guarantee uninterrupted availability.
13. Disclaimers
The Platform is provided on an "as is" and "as available" basis, to the fullest extent permitted by law. We disclaim implied warranties including merchantability, fitness for purpose, and non-infringement.
14. Limitation of Liability
To the maximum extent permitted by law, Makao Hive is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenue/data/business opportunity.
Aggregate liability for claims arising from these Terms is limited to amounts paid by you to us in the 12 months preceding the event giving rise to the claim.
15. Indemnity
You agree to indemnify and hold harmless Makao Hive, its affiliates, officers, and employees from claims arising out of your misuse of the Platform, breach of these Terms, or violation of law.
16. Suspension and Termination
We may suspend or terminate accounts for:
- breach of these Terms,
- security risk,
- unlawful conduct,
- non-payment where applicable.
Termination does not remove obligations accrued before termination.
17. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Kenya. Disputes are resolved in the courts of the Republic of Kenya, unless otherwise required by applicable law.
18. Changes to Terms
We may update these Terms. Updated versions are effective when published, unless stated otherwise. Continued use after changes means you accept the revised Terms.
